Ecocampervans Terms and Conditions

Terms and conditions are subject to change without notice.

Age

Drivers must be between 21 and 75 years of age.

Calculation of rental days

We calculate your rentals days on a daily basis

Cancellation & Refund policy

If you give 14 days notice the pre-payment and deposit will be refunded in full.

If you give 7 to 13 days notice the pre-payment will be refunded in full and half the deposit forfeited.

If you give less than 7 days notice your pre-payment will be refunded and the deposit forfeited.

If you return the camper early no refund is available.

Payments and refunds are conducted in Australian dollars. Currency fluctuations may occur and affect the amount refunded in terms of your local currency. Ecocampervans accepts no liability in this regard.
 

Extending rental

Extensions to the rental period must be authorized in advance by contacting Ecocampervans on 1800 811 646. Due to prior bookings extensions may not be possible but if they are payment must be made by credit card at the time of authorization.

Guarantees

  • New South Wales registration and annual safety inspection

Insurance excess

  • $1,000 for drivers aged 25 and over
  • $1,500 for drivers aged under 25

Merchant services/ how to pay

  • Deposit of $250 to secure your booking can be made via our website.
  • Bond: credit card essential. Age 25 and over $1000. Age 21 to 24 $1500.

Payment

Full payment is required before travelling and can be made by the following:

Credit cards – Mastercard/ Visa Card/ Bankcard via website, fax or on location.

American Express on location.

Direct money transfer or via the internet to our Westpac bank account.
Cash, traveller’s cheque or bank cheque

Personal and company cheques are not accepted.

Personal Insurance

Personal injury is covered in most cases by the vehicles CTP Green Slip Insurance that is compulsory with vehicle registration. However it is recommended that travellers have Personal Travel Insurance.

Pets

Pets are not permitted in our campers.

Traffic Infringements

All traffic infringements must be handed in when returning the camper. The customer agrees to Ecocampervans charging infringements to their credit card even if they arrive after the completion of the rental.

RENTAL VEHICLE AGREEMENT TERMS AND CONDITIONS

This is an agreement between the prospective hirer identified on Page 1 and “The Company” identified on Page 1 (the Company) to rent the motor vehicle

described on Page 1 including all accessories, tools, tyres and equipment and any replacement vehicle (the vehicle).
 

1. VEHICLE CONDITION AND RETURN

The vehicle is delivered to you in good operating condition and with the seal of the odometer unbroken. You agree to return the vehicle in the

same condition (except) for ordinary wear and tear (NOT INCLUDING WINDSCREEN DAMAGE) together with the tools, tyres, accessories

and equipment to the location collected from and on the date there specified (or sooner if demanded by the Company). The Company may

take possession of the vehicle without demand at your expense if it is illegally parked, used in violation of the law or this agreement or if it is

apparently abandoned. If the seal of the odometer is broken the persons responsible will be reported to the appropriate authority and you are

responsible for the extra charges based on 500 kilometres per day at 50c per kilometre.

Note: The Company must be notified and agree to any extension of the period or hire beyond that stated on Page 1 of this agreement in advance

of the return date and time or the vehicle will be immediately reported as stolen.
 

2. UNAUTHORISED AND PROHIBITED USE

Persons who must not drive the vehicle:

(a) A person who is not identified on Page 1.

(b) A person who is not licensed for that class of vehicle.

(c) A person whose blood alcohol concentration exceeds the lawful percentage or indicates other illicit intoxicant drugs.

(d) A person who has given or for whom you have given a false name, age, address or driver’s licence details.

(e) A person whose driver’s licence has been cancelled, endorsed or suspended within the last 3 years.

(f) A person who has not held a licence for at least 12 months (excluding any time under a Learner’s Permit or a Provisional Licence).
 

Circumstances in which and / or for which the vehicle must not be used:

(g) Outside the area of use limitations shown on Page 1.

(h) The vehicle must only be used on a road which is properly formed and constructed as a sealed, metalled or gravel road.

(i) To carry persons for hire or to carry inflammable, explosive or corrosive materials.

(j) To propel or tow any vehicle, trailer, boat or other object unless the company has authorised such use in writing.

(k) To carry any greater load and/or more persons than is lawful.

(l) For racing, pacemaking, reliability trails, speed trails, hill climbing or being tested in preparation for those purposes.

(m) In a dangerous manner.

(n) In contravention of any legislation or regulation controlling vehicular traffic or for any illegal purpose.

(o) Not use the vehicle when it is damaged or unsafe.

(p) To carry any animal or pet in the vehicle.

3. FINANCIAL OBLIGATIONS

SPECIAL NOTE: Joint hirers and all drivers are jointly and severally responsible under this agreement.

YOU ARE RESPONSIBLE FOR AND BY ENTERING INTO THE AGREEMENT ON PAGE 1 YOU ARE AUTHORISING THE COMPANY TO DEBIT YOUR CREDIT CARD/DEPOSIT (and you will pay on demand any balance) WITH THE FOLLOWING CHARGES:

(a) All rental charges specified on Page 1.

(b) All charges claimed from the company in respect of parking or any other traffic violations incurred during the period of hire or until such later times as the vehicle is returned to the company.

(c) All charges for repair to the motor vehicle (including loss of use), legal expenses, assessment fees, towing and recovery, storage and company service charges where:

(i) any condition of this agreement, and in particular Condition 2, or any special condition on Page 1 has been breached;

(ii) the vehicle is not under the control of the hirer at the time of the loss or damage;

(iii) the underbody of the vehicle is damaged regardless of cause when no other vehicle is involved;

(iv) the vehicle is totally or partially immersed in water regardless of cause or driven on snow or ice;

(v) the interior of the vehicle is damaged regardless of cause when no other vehicle is involved;

(vi) the tyres of the vehicle are damaged other than by normal wear;

(vii) the vehicle is damaged, or any third party property is damaged, by driving it under or into an object lower than the height of the vehicle;

(viii) you have failed to maintain all fluid levels and fuel levels or failed to immediately rectify or report to us any defect of which you become aware;

(ix) the vehicle is damaged by loading or unloading, other than normal wear;

(x) you have left the vehicle unlocked or left the keys in the vehicle;

(xi) you have not kept the key secure and under your personal control;

(xii) your failure to secure properly any load or equipment which leads to loss caused by any part of said load or equipment.

SPECIAL NOTE: If you have paid by used of a credit card or directed the company to bill charges to some other person, corporation,firm or organisation who or which fails to make payment when due you will immediately pay the amount due to the company on demand.

 
4. LOSS/DAMAGE WAIVER
 
If you act within the terms and conditions of this agreement the Company will grant a loss/damage waiver (including legal costs incurred with our consent) for your benefit in respect of damage to the vehicle or third party damage other than any property owned by you (or any friend, relative, associate or passenger) or in your physical or legal control. This cover is subject to:

(a) Your payment (per incident) of the damage/loss liability charge stated on Page 1, immediately (within 24 hours)

(b) You not having acted or having caused any other person to have acted in any manner which is in contravention of this agreement including the special conditions on Page 1.

(c) You not being covered under any policy or insurance.

(d) You providing such information and assistance as may be requested and if necessary, authorising the company insurer to bring, defend or settle legal proceedings, but the Company shall have sole conduct of the necessary proceedings.

5. GENERAL PROVISIONS

(a) You will promptly report any accident or loss involving the vehicle while rented under this agreement to the Company location where the vehicle was hired and will deliver to the Company immediately, every summons, complaint or paper in relation to such loss. Compliance with this sub-paragraph does not excuse the hirer from reporting an accident to police or other authorities.

(b) You release and hold harmless the Company (and its agents and employees) from all claims for loss or damage to your personal property, or that of any other person left in the vehicle or which is received, handled or stored by the Company at any time before, during or after this rental period, whether due to the Company’s negligence or otherwise.

(c) Neither Clause 5(b) or any other provision of the Rental Agreement is intended to exclude, restrict or modify any non-excludable terms implied by or rights which you may have under the Trade Practices Act 1974 (Cth) (“the TPA”) or any other State or Territory legislation to the same effect.

(d) If your Rental Agreement is a contract for the supply of “recreational services” (as defined by Section 68B of the TPA or any comparable legislation, Ecocampervans has no liability to you or an authorised driver for death or personal injury arising in connection with any breach by Ecocampervans of any term implied by Section 74 of the TPA or any comparable legislation.

(e) Except as provided by law no driver or passenger in the vehicle shall be deemed to be the agent, servant or employee of the Company in any manner for any purpose whatsoever.

(f) THE COMPANY GIVES NO EXPRESS OR IMPLIED WARRANTY AS TO ANY MATTER WHATSOEVER INCLUDING WITHOUT LIMITATION THE CONDITION OF THE VEHICLE AND EQUIPMENT, ITS MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.

(g) No right of the Company under the agreement may be waived except in writing by an officer of the Company.

(h) Words used in this agreement to denote any gender shall include all genders, singular words include the plural, or vice versa.

6. FUEL

The vehicle must be returned with the amount of fuel equal to that indicated on Page 1 (not necessarily full). Shortages may be charged at $20 each quarter tank and surpluses will not be reimbursed.
